Ground given for limiting competition

The buyer’s own stated reason for awarding without open competition, as published. Their assertion, not a finding.

The procurement falls outside the scope of application of the directive

Liverpool City Council awarded this contract following a further competition under ESPO Framework 628_23, Security and Surveillance Equipment and Services, Lot 7: Body Worn Video Cameras. The framework was established by ESPO in accordance with the Public Contracts Regulations 2015. Liverpool City Council is an eligible user of the framework and invited the suppliers appointed to the relevant lot to participate in the further competition. The tenders received were evaluated in accordance with the award criteria set out in the further-competition documents, and the call-off contract was awarded to the successful tenderer in accordance with the framework terms and regulation 33 of the Public Contracts Regulations 2015. A separate contract notice was not published by Liverpool City Council because this procurement was a call-off competition conducted under an existing, previously advertised framework agreement. The award was competitive and was not a direct award without competition.
