Terms of service

Last updated 21 October 2026

1. Who you are contracting with

TenderGraph is a product of, and is provided by, M Heath Consulting Ltd, registered in England & Wales (company number 14501165), registered office Unit 20 Tarran Way West, Tarran Industrial Estate, Wirral, England, CH46 4TT. “We” and “us” mean that company; “you” means the business that subscribes.

2. Business customers only

TenderGraph is sold only to businesses and other organisations, not to consumers. By starting a trial or a subscription you confirm that you are acting in the course of your trade, business or profession, and that you have authority to accept these terms for the organisation you name.

3. Accounts and users

Each subscription is for one named user. Additional users, or a team account, are available by arrangement — contact us. The named user's sign-in details and API keys are for that user and for the software tools that user operates, and must not be shared beyond them. You are responsible for what is done through your account and keys, and should revoke a key (under API keys in your account) as soon as you suspect it has been exposed.

4. The free trial

New subscriptions start with a 7-day free trial. A valid payment card is required to start it, and the card is not charged during the trial. A trial you cancel before it ends is never charged. If you do not cancel, your subscription begins when the trial ends and the first payment is taken then. One free trial per organisation. We may decline a further trial where your organisation has had one before, including under a different account or email address; in that case your subscription, and its first payment, start when you subscribe.

5. Price, payment and renewal

The subscription costs £99 per month or £990 per year. Prices exclude VAT. UK VAT is added at checkout; EU business customers with a valid VAT number are reverse-charged. Payment is taken in advance for each billing period, by card through Stripe; we do not receive or store your full card details. Annual plans can be invoiced by arrangement.

Your subscription renews automatically at the end of each billing period, for another period of the same length and at the price then current, until you cancel. Your next renewal date is shown under Billing in your account.

We may change the price. We will email you at least 30 days before a new price applies to you; it takes effect from your first renewal after that notice, and you can cancel before then if you do not accept it.

6. Cancelling and refunds

You can cancel at any time from Billing in your account, or by emailing hello@tendergraph.ai. Cancellation takes effect at the end of the current billing period — the trial, the month or the year you have paid for — and you keep access until then. We do not refund part-used periods as a matter of course, but if we have failed to provide the service we will put it right or refund the unused full months; tell us and we will deal with it fairly.

7. Late payment, suspension and ending the contract

If a payment fails, Stripe will retry it and your access continues for up to 21 days from the date it fell due. If it is still unpaid after that, we will suspend access — including the API, the MCP connection and webhooks — until it is paid, and we may end the subscription.

We may also suspend access, or end these terms by notice, if you materially breach them — for example by sharing credentials beyond section 3, redistributing the service in breach of section 8, or degrading the service for others — and will tell you why. Where the breach can be put right, we will first give you a reasonable opportunity to do so. You may end these terms by notice if we materially breach them and do not put it right within 30 days of being told.

8. Your licence to the data

While your subscription is active, we grant you a non-exclusive, non-transferable licence to use the service and the data it provides for your organisation's business purposes — including through AI agents, assistants and other software tools that you or the named user operate, such as an MCP client connected to TenderGraph. You may store, analyse and combine the data, and share extracts, reports and analyses with your clients and colleagues in the ordinary course of your business.

You may not resell, sublicense or redistribute TenderGraph's database or service as a whole or in substantial part, use it to build a dataset or service that competes with ours, or circumvent rate limits or access controls.

Nothing in these terms limits what a source's own licence allows you to do with that source's data. Every record states its source's licence, a link to it and the attribution to reproduce (provenance.licence in the API, and the Provenance panel on each record), and the coverage page lists every source's licence. When you publish or share data from TenderGraph outside your organisation you must keep that attribution with it, not suggest that the publisher or we endorse your use, and comply with any further condition the source's licence sets.

Data from share-alike sources — currently SECOP II (Colombia) and ANAC CIG — Italian tenders, published under CC BY-SA 4.0 — is licensed to you under that licence and not under the restrictions in this section: you may copy, adapt and redistribute it, including commercially, provided you give the attribution and share anything you adapt from it under the same licence.

Some records contain personal data — a buyer's named contact, or a supplier who is an individual. You are responsible for your own use of it under data protection law, and should use it only for purposes compatible with its publication, such as responding to or researching the procurement it relates to.

9. Your data, and the end of the subscription

Your targeting profile, tracked tenders, monitors, saved profiles and the rest of what you put into TenderGraph remain yours, and we use them only to provide the service. When a subscription ends, access stops at the end of the paid period; your account and its data stay in place, so you can resubscribe, until you ask us to delete them. Ask us at any point and we will send you a copy of that data, and delete it within one month of a deletion request, apart from billing records we must keep for tax. Reports and extracts you made during the subscription remain yours to keep, and the source licences continue to apply to the data in them.

10. The data, and its limits

TenderGraph aggregates public procurement notices and planning records published by public authorities under their own licences. We add structure, deduplication and analysis; we do not own the underlying notices, and the publishing authority's own notice is always authoritative.

Verify before you bid. Deadlines, values and requirements must be checked on the source notice, which we link on every record. Each source is collected on its own schedule, and collection can pause: every record shows when we first saw it and last updated it, and the coverage page shows when each source last synced successfully. We work hard on accuracy and publish our methodology, but we do not warrant that the data is complete, current or error-free.

11. Availability and liability

We aim for continuous availability but do not guarantee it, and upstream sources go offline outside our control. To the extent the law allows, our total liability to you arising out of or in connection with these terms in any 12-month period is limited to the greater of the fees you paid us in that period and £1,000, and we are not liable for loss of profits, revenue, contracts or bids, or for any indirect or consequential loss. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

12. Changes and governing law

We may change these terms; material changes are emailed to account holders at least 30 days before they take effect, and you may cancel if you do not accept them. These terms are governed by the laws of England & Wales, whose courts have exclusive jurisdiction.
