Description

This contract has been directly awarded to Esh Construction via the NEPO0211 Civil Engineering and Infrastructure Works Framework to deliver essential works at Watergate Forest Park. The project will reinforce the reservoir spillway and adjoining embankments at Watergate Lake to ensure compliance with the Reservoirs Act 1975. The works are required to improve the safety and resilience of the reservoir infrastructure and to reduce risks to life and property during extreme flood events, including those with 1 in 1,000-year and 1 in 10,000-year return periods. The improvements will help Gateshead Council meet its statutory obligations and maintain the long-term integrity of the reservoir.

Ground given for limiting competition

The buyer’s own stated reason for awarding without open competition, as published. Their assertion, not a finding.

The procurement falls outside the scope of application of the directive

In accordance with Regulation 108(1)(b) and 108(2) of the Public Contracts Regulations 2015 the Contracting Authority is publishing details of the Call off contract procured under the North East Procurement Organisation Framework Agreement (Civil Engineering & Infrastructure Works Lot 3) dated 20th February between North East Procurement Organisation and Esh Construction (a framework procured in accordance with Regulation 33). As the Contracting Authority is procuring under this Framework there has been no requirement to publish the opportunity prior to award.
