Ground given for limiting competition
The buyer’s own stated reason for awarding without open competition, as published. Their assertion, not a finding.
Under Regulation 33(b)(ii) of the Public Contracts (Scotland) Regulations 2015, competition is absent for technical reasons. The National Waiting Times Centre Board (Golden Jubilee) is satisfied that Trane UK Ltd is the only commercially available able to provide the Building Management System for the management and control of the main chiller plant for the Hospital and the Eye Centre in line with all statutory requirements and healthcare guidance. The existing BMS operates on Trane's proprietary Tracer Summit platform, a closed-protocol system for which Trane UK Ltd retains the exclusive access, and permissions required to modify and support the system. No alternative supplier can access or amend the system without Trane UK's direct involvement. Replacing or re-engineering the existing solution would result in disproportionate cost and potential risk on the Board's ability to maintain critical environmental controls required for the safe operation of healthcare facilities.
