Description
Der Instandhaltungsbedarf gemäß der technischen Leistungsbeschreibung (Kapitel B) umfasst den Bestand von 95 mobilen 450 l-Kraftstofftanks und einem mobilen 1000 l-Kraftstoffcontainer. Im Hinblick auf die Rahmenvereinbarung werden keine Mindestabnahmemengen vereinbart. Nach Rechtsprechung des EuGH vom 17.06.2021_RS C - 23/20 - ist der Auftraggeber zur Sicherung der Transparenz und Diskriminierungsfreiheit im Wettbewerb dazu verpflichtet, eine Höchstmenge anzugeben. Eine Abrufverpflichtung kann daraus nicht abgeleitet werden. Der Auftraggeber schätzt, dass über die gesamte Vertragslaufzeit ein Bedarf für Instandhaltung in Höhe von ca. 390.000 Euro besteht. Die Höchstmenge der anliegenden Rahmenvereinbarung wird mit 540.000 Euro beziffert.
