Ground given for limiting competition
The buyer’s own stated reason for awarding without open competition, as published. Their assertion, not a finding.
London & Quadrant Housing Trust ("L&Q") originally commenced and conducted a procurement for a framework comprising of 3 Lots, under a Tender Notice reference 2026/S 000-038379 , dated 28th April 2026, using the competitive flexible procedure under the Procurement Act 2023 ("PA 2023"). The requirement covered by this Transparency Notice formed Lot 2 of that framework (Major Works / Refurbishment - Supply Only). L&Q subsequently decided to abandon the procurement of Lots 1 and 3 and published a Procurement Termination Notice to this effect on 28 September 2026 (reference 2026/S 000-091525). The Procurement Termination Notice made it clear that L&Q's decision to abandon only related to Lots 1 and 3 of the framework, and that it intended to proceed with the procurement and award of Lot 2 of the framework as originally planned. Not withstanding the inclusion of this clear statement in the Procurement Termination Notice, publication of the Notice had the unintentional effect of ending the entire procurement on the Find a Tender system - rather than just the procurement of Lots 1 and 3 as intended. Due to the way in which the system is configured, this meant that it was no longer possible for L&Q to generate and publish a Contract Award Notice in respect of Lot 2 via the system to confirm the identity of the successful suppliers for Lot 2. In order to overcome this technical issue, L&Q is required to publish this Transparency Notice to confirm its intention to award Lot 2 to the successful suppliers set out in this Notice. This will enable L&Q to subsequently generate and publish a Contract Award Notice in respect of Lot 2 via the system as originally planned, which will mark the start of an 8 working day standstill period which is L&Q is required to observe before signature of the Lot 2 Framework. For the purposes of completing this Transparency Notice, L&Q has selected the "single suppliers - exclusive rights" direct award justification in paragraph 6 of Schedule 5 of the PA 2023 as its justification for awarding the Framework (Lot 2 - Major Works / Refurbishment - Supply Only) to the suppliers listed in this Notice. This is on the basis that these suppliers have an exclusive right to be awarded Lot 2 by virtue of the fact that they have been successful in the competitive procurement process undertaken by L&Q for Lot 2 in accordance with the PA 2023 (commenced under the Tender Notice referred to above).
