Description

Fenland District Council (the Council) intends to modify its grounds maintenance services contract (originally awarded to ISS, subsequently novated to Tivoli Group UK Limited) by extending the contract term by a further 12 months from 1 November 2026 to 31 October 2027. The Council is modifying the contract in accordance with Regulation 72(1)(c) of the Public Contracts Regulations 2015, which permits modification without a new procurement where the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen, provided that the modification does not alter the overall nature of the contract and any increase in price does not exceed 50% of the value of the original contract. The unforeseen circumstances are the ongoing uncertainty arising from Local Government Reorganisation (LGR). Four LGR proposals affecting the Council's area were submitted in November 2025. A decision on LGR in Cambridgeshire and Peterborough was expected October 2026 but was paused by the Government on 7 September 2026. This made it impracticable to commence a procurement process which would delay the successor authority aligning its ground maintenance arrangements. The modification does not alter the overall nature of the contract and the estimated value of the extension (approximately £752,000) does not exceed 50% of the original contract value of approximately £5,624,757.30. Contract Modification Notice (F20) Fenland District Council has modified its grounds maintenance services contract with Tivoli Group UK Limited (originally awarded to ISS and subsequently novated) by extending the contract term by 12 months from 1 November 2026 to 31 October 2027, at an estimated value of approximately £752,000. The modification has been made pursuant to Regulation 72(1)(c) of the Public Contracts Regulations 2015 on the basis that the need for modification was brought about by circumstances which a diligent contracting authority could not have foreseen. The modification does not alter the overall nature of the contract. The estimated value of the extension (approximately £748,000) does not exceed 50% of the original contract value of approximately £5,624,757.30.
